This website grants you non-exclusive limited license to use the Joomla! extensions and other products sold through it (http://www.tandolin.com OR http://www.tandolin.co.za) by Tandolin Consultants cc (the products) in accordance with these Terms & Conditions (the license) issued by the company.

1. Account Terms

• You must be 13 years or older to use this Service
• You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process
• Your login may only be used by one person – a single login shared by multiple people is not permitted. You may create separate logins for as many people as you'd like
• You must be a human. Accounts registered by any automated means are not permitted
• You are responsible for maintaining the security of your account and password. Tandolin cannot and will not be liable for any loss or damage from your failure to comply with this security obligation
• You are responsible for all Content posted and activity that occurs under your account
• You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws)

2. Product Licensing & Usage

Joomla! Extensions
All Joomla! extensions on Tandolin are licensed under the GNU general public license. These extensions may be used by Tandolin customers on as many websites as they like.

Adobe AIR Applications
Adobe AIR Applications are copyrighted and are not licensed under the GNU general public license. You are not allowed to redistribute these applications in any way. Standard package allows for single computer/workstation and single Joomla! server usage.

Javascript
JavaScript libraries are used in these Joomla! extensions and usually have their own license. The JavaScript code does not inherit the GPL license.

3. Membership Subscription Renewals

Purchases of Tandolin products and services is handled by 2Checkout.com. No address data nor financial information about you is requested by Tandolin when making a purchase. Your sensitive information is stored securely at the servers of 2Checkout.com and not on Tandolin websites.

Please take note that subscriptions are not automatically renewed at the end of your subscription period. If you wish to continue your subscription (i.e. you would like to extend it with a similar package to your existing one), then you need to manually purchase another subscription/product at the end of your subscription.

Subscription expiry notifications are sent out well in advance of the expiry of subscriptions.

4. Updates

Software updates are available to customers who have made at least one product/subscription purchase. They remain available for your subscription category whilst your subscription remains active.

All extensions are designed to be compatible with the latest available version of Joomla! 1.5 but we can give no guarantee, that older extensions will run with future versions of Joomla!. We are however committed to doing our best to make all the extensions compatible with future releases of Joomla!.

5. Compatibility

It is our duty to always keep the extensions up-to-date and working with the latest version of Joomla!. Tandolin extensions are developed and fine-tuned for Joomla! 1.5.23 or higher, any version prior to that may have problems with some functionality.

6. Browser Compatibility

Tandolin extensions support all modern web browsers including (but not limited to) Firefox, Safari, Chrome (all on PC & Mac) & Internet Explorer. Whilst we strive to give every a seamless & near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to HTML & CSS) in some of these browsers. In the case of a browser not support certain web standards, we will include a generic workaround for that browser, which will degrade a specific function / feature gradually and in a way that does not affect the user experience negatively.

7. Delivery

After your payment has been successfully received, your Tandolin Subscription or Purchase information will be emailed to the email address you provided. This may take up to 1 hour but usually happens within minutes. If you do not receive an email after this time period, contact us through our website. Upon logging in with the provided credentials, you will have instant access to all our themes and the support forum.

Note: No invoices will be available for your purchases / subscriptions, as the 2Checkout.com sales receipt is deemed to be sufficient financial information.

8. Ownership

You may not claim intellectual or exclusive ownership to any Tandolin products, modified or unmodified. All products are property of Tandolin. These products are provided as is without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

9. Site Content

All content, including imagery, published on the tandolin.com domain, including site content published on the showcase, is property of Tandolin and under copyright. Any replicated site content must be authorized and clearly referenced back to the source. Content from the Tandolin web site shall not be used or exploited for any commercial and non-private purposes without the prior written consent of Tandolin.

10. Member Access and Downloads

As a member your username and password is for your personal use only.

If it's discovered that you share or give out your username and password, your membership account will be terminated immediately.

CAUTION: Your IP address, credit card and email address may be banned for a period of up to 5 years as a result of such conduct.

You are also not allowed to use a spider, web crawler, or other same automated tools to download the content from our site.

11. Refund Policy

Since Tandolin is offering non-tangible irrevocable, digital goods, the company will only issue refunds if your account has not been logged into (or your downloads counter hasn't been incremented) after the subscription or individual purchase is made. You are responsible for understanding this upon registering at the tandolin site.

There will be no refunds or credits for partial months of service, package/product upgrade/downgrades, nor refunds for months unused with an open account. Everybody is treated equally and no exceptions will be made

Refund requests will always be subject to discussion with the customer - especially when personal service on the customers own website has been carried out. If Tandolin deems the already provided service to be substantial enough, the refund request will be denied

12. Support

Tandolin offers these extensions "as is", with no implied meaning that they will function exactly as you wish or with all 3rd party Joomla! extensions. 13. Price Changes

Tandolin reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a product/subscription (or any part thereof) with or without notice. Prices of all subscriptions and products, including but not limited to monthly subscription plan fees, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Tandolin website.

14. Warranty

Tandolin does not warrant or guarantee these extensions in any manner. We cannot guarantee they will function with all 3rd party components, future Joomla! versions or web browsers. Browser compatibility should be tested against the demonstration extensions on the demo server. Please ensure that the browsers you use will work with the extensions as we can not guarantee that Tandolin extensions will work with all browser combinations.

15. Denial of Service

Tandolin.com reserves the right to refuse, cancel, or suspend service at will.

16. Severability

If any portion or term of this agreement is found to be unenforceable, this will not affect the validity of the rest of the terms in this document. This means that the agreement will remain effective and enforceable on its remaining terms and conditions.
